Welcome to DaylyFlow. By accessing or using our website at daylyflow.com, creating an account, or purchasing any services (collectively, the "Service" or "Platform"), you enter into a legally binding agreement governed by these Terms of Service ("Terms").

If you do not agree to these Terms, you must not access or use DaylyFlow.

Eligibility: You must be at least 13 years of age (or the minimum legal age of digital consent in your jurisdiction, such as 16 in certain EU states) to create an account or use this Service. By using DaylyFlow, you represent and warrant that you meet this requirement.

2. Account Registration & Security

To unlock specific features such as cloud synchronization and AI scheduling, you may register an account using your email address, Google account, or GitHub account.

  • You agree to provide true, current, and complete information during registration.
  • You are solely responsible for maintaining the confidentiality of your login credentials and for all activities that occur under your account.
  • You agree to notify DaylyFlow immediately at [email protected] if you suspect any unauthorized access to your account.

3. Free Plan, Pro Subscriptions & Refund Guarantee

DaylyFlow provides both a fully functional Free Tier and premium Pro subscription plans:

  • Free Tier: Includes daily timeline planning (up to 5 tasks per day), basic habit tracking (up to 3 habits), theme customizations, and standard local storage. No credit card is required.

The habit streaks, routine templates, and schedule prompts are not intended to diagnose, treat, prevent, or cure any medical condition, mental health disorder, or sleep pathology. Always consult a qualified healthcare or medical professional regarding physical or psychological concerns.

5. AI Assistant Features & User Responsibility

DaylyFlow includes automated generative artificial intelligence features that assist in drafting schedules, prioritizing tasks, and suggesting daily workflows:

  • Informational Suggestions Only: AI schedule generation is provided for planning inspiration only. AI algorithms may occasionally produce inaccurate, unfeasible, or unexpected schedules ("hallucinations").
  • User Verification: You are solely responsible for reviewing, verifying, and confirming all appointment times, deadlines, and commitments before relying on them. DaylyFlow is not liable for missed meetings, appointments, or deadlines resulting from AI-generated schedules.
  • Acceptable AI Use: You agree not to use the AI assistant to generate harmful, abusive, defamatory, sexually explicit, or unlawful content.

6. Acceptable Use & Prohibited Conduct

You agree that you will NOT:

  • Use DaylyFlow for any fraudulent, illegal, or unauthorized purpose.
  • Attempt to reverse-engineer, decompile, crawl, scrape, or extract source code from the Service without written authorization.
  • Interfere with or compromise the system integrity, performance, or security of our servers and networks.
  • Transmit malicious code, viruses, automated bots, or spam payloads through any input fields or forms.
  • Impersonate another individual or falsely state an affiliation with any company or entity.

7. Intellectual Property & User Content

DaylyFlow Intellectual Property: The DaylyFlow brand name, trademarks, logos, custom software code, UI designs, mesh gradients, visual components, and documentation are the exclusive property of DaylyFlow and protected by international intellectual property laws.

Your Content Ownership: You retain 100% intellectual property ownership of all tasks, habit names, schedule notes, and personal content you create within DaylyFlow. You grant DaylyFlow a limited, worldwide, non-exclusive license solely to host, store, and display your content to you as required to operate the Service.

8. DMCA & Copyright Infringement Notice

We respect the intellectual property rights of others. If you believe that any content hosted on DaylyFlow infringes upon your copyright, please send a formal DMCA takedown notification to our designated copyright agent:

9. Disclaimers & Limitation of Liability

DaylyFlow is provided on an "AS IS" and "AS AVAILABLE" basis without warranties of any kind, whether express, statutory, or implied, including merchantability, fitness for a particular purpose, and non-infringement.

To the maximum extent permitted by applicable law, in no event shall DaylyFlow, its founders, directors, employees, or contractors be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data loss, or business interruption, arising out of or in connection with your use of or inability to use the Service.

In any circumstance, DaylyFlow's total aggregate liability shall not exceed the amount actually paid by you to DaylyFlow during the twelve (12) months preceding the claim, or $50 USD, whichever is greater.

10. Governing Law & Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of the jurisdiction of DaylyFlow's principal operations, without regard to its conflict of law provisions.

Informal Resolution First: Before initiating any formal legal claim, you and DaylyFlow agree to attempt to resolve any dispute, controversy, or claim informally by contacting our legal team at [email protected] for at least 30 days.

Severability: If any provision of these Terms is deemed unlawful, void, or unenforceable, that provision shall be deemed severable and shall not affect the validity and enforceability of the remaining provisions.
